PART III.  OPERATION OF VEHICLES

CHAPTER 31. GENERAL PROVISIONS

General statements about Traffic control devices. This is the section you want to be cited for rather than "speeding" or anything else. No points.

§ 3111. Obedience to traffic-control devices

(a) General rule.--Unless otherwise directed by a uniformed police officer or any appropriately attired person authorized to direct, control or regulate traffic, the driver of any vehicle shall obey the instructions of any applicable official traffic-control device placed or held in accordance with the provisions of this title, subject to the privileges granted the driver of an emergency vehicle in this title.

(b) Proper position and legibility of device.-No provision of this title for which official traffic-control devices are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official device is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that official traffic-control devices are required, the section shall be effective even though no devices are erected or in place.

(c) Presumption of authorized placement.--Whenever official traffic-control devices are placed or held in position approximately conforming to the requirements of this title, the devices shall be presumed to have been so placed by the official act or direction of lawful authority, unless the contrary shall be established by competent evidence.

(d) Presumption of proper devices.--Any official traffic-control device placed or held pursuant to the provisions of this title and purporting to conform to the lawful requirements pertaining to such devices shall be presumed to comply with the requirements of this title, unless the contrary shall be established by competent evidence.

§ 3112. Traffic-control signals

Sections that appear to be applicable to Traffic Control signals (vehicle sensing loops) that do not operate properly for motorcyles. The sense loops are not set properly for motorcycles. Look for a large box on one corner of the intersection.

(c) Inoperable or malfunctioning signal.--If a traffic- control signal is out of operation or is not functioning properly, vehicular traffic facing a:

(1) Green or yellow signal may proceed with caution as indicated in subsection (a)(1) and (2).

(2) Red or completely unlighted signal shall stop in the same manner as at a stop sign, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign as provided in section 3323 (relating to stop signs and yield signs).

CHAPTER 33.  RULES OF THE ROAD IN GENERAL

§ 3303. Overtaking vehicle on the left

Note that if a vehicle speeds up when you pass, they are guilty of RACING in PA per 3367!  No one wants that in their record.

(a) General rule.--The following rules shall govern the overtaking andpassing of vehicles proceeding in the same direction, subject to the limitations, exceptions and special rules stated in this chapter:
(1) The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left of the other vehicle at a safe distance and shall stay to the left of the other vehicle until safely clear of the overtaken vehicle.
(2) Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall not increase the speed of the vehicle until completely passed by the overtaking vehicle and shall give way to the right in favor of the overtaking vehicle on suitable signal. (b) Suitable signal defined.--Suitable signal for purposes of subsection (a)(2) shall be as follows:
   (1) At all times when head lamps are required to be lighted according to section 4302 (relating to the period for requiring lighted lamps), an audible signal or the intermittent flashing of low and high beams except that the use of high beams shall not be permitted when a vehicle is approaching from the opposite direction within 500 feet.
   (2) At all other times, an audible signal.

§ 3305, Limitations on overtaking on the left

No vehicle shall be driven to the left side of the center or marked centerline of the roadway in overtaking and passing another vehicle proceeding in the same direction unless the left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit the overtaking and passing to be completely made without interfering with the operation of any vehicle approaching from the opposite direction or any vehicle overtaken.  In every event the overtaking vehicle must return to an authorized lane of travel as soon as practicable and, in the event the passing movement involves the use of a lane authorized for vehicles approaching from the opposite direction, before coming within 200 feet of any approaching vehicle.

§ 3307. No-passing zones

The No-Passing Zone law. Note that in section (b) signs and markings are needed. Section (a) might be interpreted differently. Again, see an attorney, if cited.

(a) Establishment and marking.--The department and local authorities may determine those portions of any highway under their respective jurisdictions where overtaking and passing or driving on the left side of the roadway would be especially hazardous and shall by appropriate signs or markings on the roadway indicate the beginning and end of such zones and when the signs or markings are in place and clearly visible to an ordinarily observant person every driver of a vehicle shall obey the directions of the signs or markings.  Signs shall be placed to indicate the beginning and end of each no-passing zone.
(b) Compliance by drivers.--Where signs and markings are in place to define a no-passing zone as set forth in subsection (a), no driver shall at any time drive on the left side of the roadway within the no-passing zone or on the left side of any pavement striping designed to mark a no-passing zone throughout its length.
(c) Application of section.--This section does not apply under the conditions described in section 3301(a)(2) and (5) (relating to driving on right side of  roadway).

§ 3323. Stop signs and yield signs.

(b) Duties at stop signs.--Except when directed to proceed by a police officer or appropriately attired persons authorized to direct, control or regulate traffic, every driver of a vehicle approaching a stop sign shall stop at a clearly marked stop line or, if no stop line is present, before entering a crosswalk on the near side of the intersection or, if no crosswalk is present, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering. If, after stopping at a crosswalk or clearly marked stop line, a driver does not have a clear view of approaching traffic, the driver shall, after yielding the right-of-way to any pedestrian in the crosswalk, slowly pull forward from the stopped position to a point where the driver has a clear view of approaching traffic. The driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute a hazard during the time when the driver is moving across or within the intersection or junction of roadways, and enter the intersection when it is safe to do so.

The testimony of a bystander who observes a violation of this section, if believed by the trial court, is sufficient alone to support a conviction despite contrary testimony from the motorist as to the events which occurred. See Commonwealth v. Dougherty, 451 Pa. Superior Ct. 248,679 A.2d 779 (1996).

§ 3367. Racing on highways.

(a) Definitions.--As used in this section the following words and phrases shall have the meanings given to them in this subsection:

"Drag race."
The operation of two or more vehicles from a point side by side at accelerating speeds in a competitive attempt to outdistance each other, or the operation of one or more vehicles over a common selected course, from the same point to the same point, for the purpose of comparing the relative speeds or power of acceleration of the vehicle or vehicles within a certain distance or time limit.

"Race."
The use of one or more vehicles in an attempt to outgain, outdistance or prevent another vehicle from passing, to arrive at a given destination ahead of another vehicle or vehicles, or to test the physical stamina or endurance of drivers over long distance driving routes.

(b) General rule.--No person shall drive a vehicle on a highway in any race, speed competition or contest, drag race or acceleration contest, test of physical endurance, exhibition of speed or acceleration, or for the purpose of making a speed record, and no person shall in any manner participate in any such race, competition, contest, test or exhibition.

(c) Permits for special activities.--The department or local authorities within their jurisdiction may issue permits for special activities which would otherwise be prohibited by this section.

(d) Penalty.--Any person violating this section is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $200.


From the PennDOT construction standards:

104.05 CLEANING OF PROJECT SITE

     Remove silt and other deposits from newly constructed culverts, inlet, outlet and parallel ditches, bridges, and other drainage structures, including stream channels. Clean and remove surplus and discarded material, equipment, and temporary structures from the project and adjacent properties, including waste and borrow areas.  Remove debris and objectionable material from areas used or disturbed by the construction operations on, or within sight of, the highway.
     Remove paint marks or spills, stains, rust marks, oil, or other unsuitable marks, as directed.  Rerstore waste and borrow areas, as specified in Section 105.14.
     Maintain the vegetation within the constructed slope limits, including waste and borrow areas, and leave the project in presentable condition.
The project will not be considered complete until the above work has been completed.

901.3 CONSTRUCTION

(j) Dropoffs.  The following conditions and treatments apply only to dropoffs created by construction, maintenance, or permit/utility operations.
     Drainage ditches are not considered as dropoffs
     When channelizing devices are used for a dropoff condition, a minimum of 2 devices are required
     If a dropoff is greater than 6 inches and the distance from the dropoff to the edge of the travel lane is such that channelizing devices must be placed below grade, position the devices on a stable platform so that the bottoms are at grade.
     Temporary concrete median barrier may be used at the discretion of the Engineer.
          1. Dropoffs between travel lanes.  If a dropoff less than or equal to 2 inches exists between travel lanes, channelizing devices are not required.  If a dropoff greater than 2 inches exists between lanes, provide the following as required:
     o On multilane highways, close one or more lanes to prevent vehicles from crossing over the dropoff.
     o On two-way, two-lane roadways, install "Do Not Pass" signs (R4-1) in each direction, at intervals not exceeding 1/2-mile, throughout the dropoff condition and install two-direction no passing zone, standard pavement markings in accordance with Figure 3, 67 Pa Code, Chapter 203.
          2. Dropoffs Between the Edge of the Travel Lane and the Shoulder.  If a dropoff less than or equal to 2 inches exists between the edge of the travel lane and the shoulder, channelizing devices are not required.  If a dropoff greater than 2 inches exists, install channelizing devices throughout the dropoff condition.  Install "Low Shoulder" signs (W8-11), at intervals not exceeding 1/2-mile, throughout the dropoff condition to supplement the channelizing devices.
          3. Dropoffs In or Beyond the Shoulder.  If a dropoff less than or equal to 2 inches exists in or beyond the shoulder area, channelizing devices are not required.  If a dropoff greater than 2 inches exists in or beyond the shoulder area, install channelizing devices throughout the dropoff condition, unless the dropoff is:
     o Outside the right-of way, or
     o Behind the guide rail, or
     o Behind curb, or
     o 15 feet or more from the edge of the roadway.
  4. Spacing of Channelizing Devices for Dropoffs.  Space all channelizing devices at 2 times the normal speed limit in feet or closer, as directed.
